Manager:

On Friday, Jan. 23rd, at 15:35:10 Pacific time, we received an order for a "fake newspaper" from your company. The contact name was "Alessandro Boselli". A copy of the order transcript is attached.

We received her payment at that time, but did not receive her story which was needed to process the order. At 4:33 Pacific an automated note was sent to her inquiring of the missing story-form.

We subsequently received two "story submission forms" from her, one from IP address 152.163.252.70, and another from IP address 12.42.51.27.

The order was processed, printed, and shipped on Jan. 23rd at 6:06 p.m. The tracking number for USPS Priority Mail was 0103 8555 7492 9900 0465 (you may run the tracking number on the USPS website yourself). Alessandro was sent an email from us advising that the order had been shipped, and was also sent an email from USPS advising her of same, and providing her with a tracking number. We can prove she received the latter.

Late in the evening of the 23rd Alessandro submitted yet another story-form. We replied to her that since her order had already shipped, no changes to the story could be made(!).

On February 6th we received an email from Alessandro claiming that her order had not arrived, but that the tracking screen showed it had been sent to the wrong zip code (10272 instead of 10292 which is the proper zip code). She insulted and berated us as follows:

"...Very poor service (you ask the customer to check for spelling mistakes
because you will not be responsible for them but if the mistake is on your
part what am I to do???) and follow up on your part to make sure that
delivery occurs....like send a feedback e-mail asking for satisfaction with
service and how the order looks!!!"

In point of fact, we DO send out an email inquiring of the customers' satisfaction. Ms. Alessandro had received it directly from Yahoo Shopping. Within 3 minutes of receiving the above email, which was the first contact we'd had with her, we emailed back a photocopy of the mailing label that was affixed to her order. It appears below:

Obviously the order was sent to the correct address, but was delivered to the wrong zip code by USPS. We advised Ms. Alessandro of this fact and asked that she not continue to berate us for something we did not do. We were considering re-making the order for free, which is against our posted policy when the customer chooses an uninsured (and therefore cheaper) shipping method. We were hoping this individual could calm down and become rational enough to deal with. She did not contact us in reply, but instead went into our on-line store and filed the following feedback report which appears for public view and which cannot be deleted:

Alessandro now states in writing:

"I did not berate nor chastise TrixiePixGraphics, for the missing package..." (quote)

So, folks, we've had enough. We consider this a clear case of defamation.
We have advised Alessandra to cease and desist contacting us. Yet she continues to email. We have blocked incoming messages from her and we now consider this to be a case of criminal harassment as well as defamation.

This will serve as legal notice for your company and its employees, all-inclusively, to cease and desist contacting us in any way, shape or form. Failure to comply will result in immediate charges of criminal harassment. Regarding the defamation aspect, we will consider a course of action at a later date, and our decision may depend on whether or not we experience further problems from this individual. Alessandro has been advised that no further orders from her will be accepted, and that she is no longer welcome to visit our website. IP addresses are recorded for all site visitors.
